The Method of Committing Crimes Provided forin Articles 151 and 151.2 of the Criminal Code of the Russian Federation: Legislative and Law Enforcement Aspects

The article, based on a comprehensive analysis of the norms of criminal law, the provisions of the doctrine of criminal law, explanations of the Plenum of the Supreme Court of the Russian Federation and materials of specific judicial practice, characterizes the methods of involving minors in committing antisocial (Article 151 of the Criminal Code of the Russian Federation) and illegal actions that pose a danger to their lives (Article 151.2 of the Criminal Code of the Russian Federation) and reveals differences in their legislative regulation. The author emphasizes that if the disposition of Art. 151 of the Criminal Code of the Russian Federation does not contain a list of methods of committing a crime, then Art. 151.2 of the Criminal Code of the Russian Federation, on the contrary, enshrines such a list by law. At the same time, the listed methods are noticeably different from those provided forin Art. 150 of the Criminal Code of the Russian Federation, althoughin their legal design these corpus delicti are similar. In addition, there is a discrepancy in the understanding of identical methods when qualifying an act under Art. 150 of the Criminal Code of the Russian Federation and Art. 151 of the Criminal Code of the Russian Federation, in particular, the specifics of such a method as a proposal, the content of whichis interpreted ambiguously by law enforcement officers. Based on the results of the study, the author formulated proposals forimproving the text of the criminal law and the provisions of the Resolution of the Plenum of the Supreme Court of the Russian Federation. The proposed changes are focused on strengthening the uniformity of judicial practice and minimizing the risks of errors in the qualification of the deed.
