Standardization as a Means of Public Law Regulation of Entrepreneurial Activities

Based on scholarly articles, the study examines the essence of standardization at the current stage of public law development and its role as a means of public law regulation of entrepreneurial activities. The author substantiates that the evolution of standardization is characterized by the expansion of its object. In the traditional sense, this object primarily encompassed a system of technical requirements for goods, services and technological processes. However, nowadays it also includes requirements for the economic entities themselves (including entrepreneurial ones), as well as for the conformity of economic activity with public interests. A brief review of the current standards regulating particular aspects of entrepreneurship is provided, and a conclusion is drawn regarding the distinction between professional and entrepreneurial activities. Based on the comparison of the institutions of strategic planning and standardization, the author proposes to distinguish the streamlining of administrative and economic relations and their alignment with the system of national interests and the goals of socio-economic development as a separate function of standardization in the field of entrepreneurial activities. The concept of “constructive entrepreneurship” is formulated to denote the entrepreneurial activity that makes a constructive contribution to public welfare and socio-economic development. The necessity of developing a national standard for constructive entrepreneurship is substantiated, and the object of standardization is defined. It is proposed that the relevance of entrepreneurship to the criteria enshrined in strategic planning documents be reflected in a constructive entrepreneurship rating, the content and calculation methods of which should be established in the corresponding standard.
