Статья посвящена анализу проблем реализации права на судебный контроль в порядке статьи 125 УПК РФ лицами с неопределенным процессуальным статусом. На основе изучения правовых позиций Конституционного Суда РФ, Пленума Верховного Суда РФ и кассационной практики 2020-2024 годов выявлено системное несоответствие между нормативным признанием права на обжалование и ограничительной практикой нижестоящих судов. Определены пять барьеров доступности и сформулированы предложения de lege ferenda по их преодолению.

Judicial review under article 125 of the Criminal Procedure Code of the Russian Federation as a guarantee of the rights of persons with an undefined procedural status: problems of accessibility and effectiveness
The article is devoted to the analysis of the problems of exercising the right to judicial review under Article 125 of the Criminal Procedure Code of the Russian Federation by persons with an undefined procedural status. Based on the study of ratio decidendi of the Constitutional Court, the Plenum of the Supreme Court, and cassation practice of 2020–2024, a systemic discrepancy between the normative recognition of the right to appeal and the restrictive practice of lower courts is identified. Five barriers to accessibility are determined and proposals de lege ferenda for their elimination are formulated.
