Meaning of the Punishment in Islam and Law
This article examines the evolution of the fight against torture within the framework of global and national legal systems. In particular, the legal practice of the Soviet period, the guarantees enshrined in the Constitution and the Criminal Code (Articles 404 and 405) of the Kyrgyz Republic, the UN Convention, and the precedents of the European Court of Human Rights (ECtHR) are analyzed. The text provides an analysis of the legal assessment regarding the applicability of the statute of limitations to crimes related to torture and crimes against humanity. Research materials and methods: this article presents a comprehensive analysis of the concept of torture, its physical and psychological forms, and the status of this phenomenon in Islamic law (Sharia) and in modern international and national legal systems. Based on the verses of the Holy Quran, the hadiths of the Prophet (peace and blessings of Allah be upon him), and the principles of Islamic jurisprudence (fiqh), the author scientifically demonstrates that in Islam, human life, dignity, and honor are inviolable, and the use of torture—even against persons suspected of committing crimes or against animals—is considered "haram" (a strictly prohibited action). Torture has no place in either Islam or modern legal systems. It goes without saying that torture, which has no religious or legal justification, will never be accepted with a clear conscience or justified for the sake of worldly interests.
