Отдельные вопросы организации незаконной миграции

В статье кратко рассмотрены отдельные вопросы организации незаконной миграции. Изучено понятие «миграция» как сложного социального процесса, рассмотрены понятия «незаконная миграция» и «организация незаконной миграции» - положения ст. 322.1 УК РФ. Исследованы вопросы организации расследования и организации совершения преступления. С учетом сложности рассматриваемых проблем, исследованы вопросы структуры и механизма организации незаконной миграции, т.е. уголовно-правовых и криминалистических проблем данного преступления. Рассмотрены взаимосвязанные элементы механизма организации незаконно миграции: въезд в страну иностранцев и лиц без гражданства, перемещения по территории, проживания и другие; дана характеристика способов и обстановки совершения незаконной миграции. Рассмотрен вопрос о возможной уголовной ответственности юридических лиц за организацию незаконной миграции. Уделено внимание описанию признаков личности субъектов организации незаконной миграции и личности мигрантов. С учетом повышенной социальной значимости проблем незаконной миграции в настоящее время, в статье кратко рассмотрены основные организационные и уголовно-правовые вопросы направления нейтрализации и устранения организации незаконной миграции.

Selected issues in the organization of illegal migration
The article briefly considers some issues of organising illegal migration. The concept of migration as a complex social process is studied, the concept of illegal migration and organisation of illegal migration - the provisions of Art. 322.1 of the Criminal Code of the Russian Federation are considered. The issues of the concept of organisation of investigation and organisation of committing a crime have been studied. Taking into account the complexity of the problems under consideration, the issues of structure and mechanism of organisation of illegal migration, i.e. criminal-legal and criminalistic problems of this crime are investigated. The interrelated elements of the mechanism of organising illegal migration are considered: entry into the country of foreigners and stateless persons, movement within the territory, residence and others; the characteristic of ways and conditions of committing illegal migration is given. The question of possible criminal liability of legal entities for organising illegal migration is considered. Attention is paid to the description of the characteristics of the identity of the subjects of the organisation of illegal migration and the identity of migrants. Taking into account the increased social significance of the problems of illegal migration at present, the article briefly considers the main organisational and criminal-legal issues of the direction of neutralisation and elimination of the organisation of illegal migration.
