Пенитенциарные факторы в контексте профилактики рецидивной преступности: зарубежный опыт

Причины постпенитенциарной рецидивной преступности связаны не только с проблемами исправления осужденных, но и с рядом иных факторов, которые обуславливают рецидивоопасность освобождаемых лиц. Плюралистический подход зарубежных исследователей к «нетипичным» факторам пенитенциарной действительности показал, что размеры пенитенциарного учреждения и его дизайнерские особенности способны демонстрировать как кризис тюрьмы, так и ликвидность спроса на тюремное заключение. Анализ современной криминологической научной литературы позволил обнаружить, что проявлением стратегии «новой пенологии» выступает концепция «тюрем быстрого строительства», которая предполагает возведение исправительного учреждения по проекту, максимально отражающему существующие национальные интересы обеспечения внешней и внутренней криминологической, экологической и санитарной безопасности тюремного комплекса, экономической рентабильности и реализации международных пенитенциарных стандартов содержания заключенных.Делается вывод о том, что в условиях возрастания полиструктурности и мультирежимности отечественных исправительных учреждений при реформировании уголовно-исполнительной системы и в целях оптимизации предупреждения постпенитенциарной преступности необходимо учитывать все пенитенциарные факторы.
