Специфика обстановки совершения преступлений, предусмотренных статьей 321 УК РФ (по материалам судебной практики)

Основываясь на анализе практики рассмотрения разнообразными судебными инстанциями уголовных дел по дезорганизации деятельности учреждений, осуществляющих изоляцию от общества, исследована специфика обстановки совершения преступлений, предусмотренных ст. 321 УК РФ в результате чего сделаны выводы, что место и время совершения деяния напрямую связано с особенностями обстановки его совершения, свойствами социальной среды, личностью преступника и рядом иных факторов; основным местом совершения дезорганизации деятельности учреждений, осуществляющих изоляцию от общества, является жилая зона исправительного учреждения; наиболее часто встречающимся в изученных нами приговорах временем совершения данного деяния признается промежуток суток с 8.00 до 18.00 часов; орудия и средства совершения преступления - это, прежде всего мускульная сила осужденного; к особенностям обстановки, способствующей совершению анализируемого состава, следует относить своеобразность криминальной субкультуры.

The specifics of the situation of committing crimes under Article 321 of the Criminal Code of the Russian Federation (based on the materials of judicial practice)
Based on the analysis of the practice of consideration by various judicial instances of criminal cases on the disorganization of the activities of institutions engaged in isolation from society, the specifics of the situation of committing crimes under Article 321 of the Criminal Code of the Russian Federation are investigated, as a result of which conclusions are drawn that the place and time of the commission of the act is directly related to the specifics of the situation of its commission, the properties of the social environment, the personality of the criminal and a number of other factors; the main place where the disorganization of the activities of institutions that isolate from society is committed is the residential area of a correctional institution; the most common time of committing this act in the sentences studied by us is the period of the day from 8.00 to 18.00 hours; the instruments and means of committing a crime are, first of all, the muscular strength of the convict; to the peculiarities of the situation conducive to the commission of the analyzed composition, it should be attributed to the originality of the criminal subculture.
