Актуальность исследования обусловлена необходимостью осмысления трансформации системы интеллектуальной собственности в условиях культурных изменений и растущего социального запроса на свободный доступ к информации. Понимание культурных основ этого правового института позволяет прогнозировать его дальнейшее развитие. Методология статьи основана на культурологическом и историческом анализе, рассматривающем право как феномен, производный от социальных и ценностных ориентиров общества. Содержание работы раскрывает взаимосвязь к ультурных парадигм и правового регулирования интеллектуальной собственности. Автор прослеживает и сторическую трансформацию о тношения к творческому труду о т эпохи Античности, Средневековья, Возрождения к формированию национальных и международных правовых систем в XIX–XXI вв. Основные выводы свидетельствуют о том, что ключевые реформы в сфере интеллектуальной собственности (первые патентные статуты, авторские законы, международные конвенции) были прямым следствием глубинных культурных изменений. Утверждение антропоцентризма и ценности индивидуального творчества стало катализатором для правового признания и охраны результатов интеллектуальной деятельности. Современное развитие этой системы требует дальнейшего культурологического осмысления новых реалий, включая цифровизацию и креативные индустрии.

The influence of the evolution of European culture on the formation of the institution of intellectual property
The relevance of the study is driven by the need to comprehend the transformation of the intellectual property system amidst cultural changes and the growing societal demand for free access to information. Understanding the cultural foundations of this legal institution allows for forecasting its future development. The methodology of the article is based on cultural and historical analysis, viewing law as a phenomenon derived from the social and value orientations of society. The content of the work reveals the interplay between cultural paradigms and the legal regulation of intellectual property. The author traces the historical transformation of the attitude towards creative labor – from its antique origins and the denial of authorship in the Middle Ages, through the affirmation of the value of the individual during the Renaissance, to the formation of national and international legal systems in the 19th‑21st centuries. The main findings indicate that key reforms in the field of intellectual property (the first patent statutes, copyright laws, international conventions) were direct consequences of profound cultural shifts. The establishment of anthropocentrism and the value of individual creativity served as a catalyst for the legal recognition and protection of intellectual activity outcomes. The contemporary development of this system requires further cultural understanding of new realities, including digitalization and creative industries.
