Правовые аспекты суррогатного материнства

В данной статье рассматриваются правовые аспекты суррогатного материнства в РФ, а также предлагается пересмотр терминологии, используемой в законодательстве для этого явления. Проводится анализ эмоциональных и оценочных ассоциаций, связанных с термином «суррогатная мать», и предлагается заменить его на термин «договорная мать» для повышения нейтральности и точности описания сути процесса. В заключение, авторы обсуждают потенциальные последствия внесения изменений в терминологию и призывают к дальнейшему изучению данной проблематики с целью улучшения правового регулирования суррогатного материнства в России, в частности, предлагается избегать использования в нормативных актах, регулирующих процесс применения технологии суррогатного материнства, термина «суррогатная мать», а заменить его более на «договорная мать».

Legal aspects of surrogacy
The scientific article examines the ethical and legal aspects of surrogacy in the RF, and also proposes a revision of the terminology used in legislation for this phenomenon. The author discusses the shortcomings of the current legal regulation of surrogacy, identifying problems in the area of responsibility of the parties, protecting the rights of children and surrogate mothers, as well as issues of medical ethics. An analysis of the emotional and evaluative associations associated with the term «surrogate mother» is carried out and it is proposed to replace it with the term «contractual mother» to increase the neutrality and accuracy of the description of the essence of the process. In conclusion, the author discusses the potential consequences of changes in terminology and calls for further study of this issue in order to improve the legal regulation of surrogacy in Russia, In particular, it is proposed to avoid the use of the term «surrogate mother» in regulations governing the process of using surrogacy technology, and replace it with more «contractual mother».
