Возбуждение уголовного дела и типичные следственные ситуации первоначального этапа расследования злоупотреблений полномочиями при выполнении гособоронзаказа

В статье рассмотрены два составных элемента первоначального этапа: возбуждение уголовного дела и типичные следственные ситуации в расследовании злоупотребления полномочиями при выполнении государственного оборонного заказа (ст. 2011 УК РФ). Проанализированы отдельные элементы криминалистической характеристики злоупотребления при выполнении гособоронзаказа. Рассмотрено содержание формирования, утверждения, размещения и работ по реализации гособоронзаказа. Исследована структура проверки признаков преступления в ходе формирования, размещения и выполнения гособоронзаказа. Рассмотрено понятие «следственная ситуация» и изучены типичные следственные ситуации, которые складываются к моменту возбуждения уголовного дела по признакам преступления, предусмотренного ст. 2011 УК РФ. Проанализировано их содержание и значение для последующего определения обстоятельств расследования рассматриваемого преступления. Проведен анализ четырех типичных следственных ситуаций первоначального этапа расследования злоупотреблений полномочиями лиц, участвующих в выполнении гособоронзаказа.

Initiation of criminal proceedings and typical investigative situations of the initial stage of investigation of abuse of authority in the fulfillment of state defense contracts
The article considers two constituent elements of the initial stage: initiation of criminal proceedings and typical investigative situations in the investigation of abuse of power in the performance of state defense order (article 2011 of the Criminal Code of the Russian Federation). The separate elements of the criminalistic characteristic of abuse in the performance of the state defense order are analyzed. The content of formation, approval, placement and work on the implementation of the state defense order is considered. The structure of verification of signs of crime in the course of formation, placement and implementation of the state defense order is studied. The concept of investigative situation is considered and typical investigative situations that are formed by the moment of initiation of criminal proceedings on the signs of a crime under Art. 2011 of the Criminal Code of the Russian Federation are studied. Their content and significance for the subsequent determination of the circumstances of the investigation of the crime in question is considered. The analysis of four typical investigative situations of the initial stage of the investigation of abuse of authority of persons involved in the implementation of state defense contracts is made.
