Особенности проведения первоначальных разыскных мероприятий и задержания лиц, состоящих на учете уголовно-исполнительных инспекций

Статья посвящена важной теме проведения первоначальных розыскных мероприятий в отношении осужденных к наказаниям без изоляции от общества. Сотрудники уголовно-исполнительных инспекций на постоянной основе проводят указанные мероприятий в отношении лиц, уклоняющихся от их контроля, при этом сталкиваются с рядом проблем. Цель исследования: выявить проблемные аспекты проведения сотрудниками уголовно-исполнительных инспекций первоначальных розыскных мероприятий и внести предложения по совершенствованию уголовно-исполнительного законодательства РФ в целях решения выявленных проблем.

The specifics of conducting initial search operations and detaining persons registered with the penal enforcement inspectorate
The article is devoted to the important topic of conducting initial investigative measures against those sentenced to punishment without isolation from society. Employees of penal enforcement inspections on an ongoing basis carry out these measures against persons who evade their control, while facing a number of problems. The purpose of the study: to identify problematic aspects of the conduct of initial investigative measures by employees of penal enforcement inspections and to make proposals for improving the penal enforcement legislation of the Russian Federation in order to solve the identified problems. Research methods: special legal methods (formal-logical, comparative-legal), empirical methods (included observation, interviews of employees of branches of penal enforcement inspections in various regions of Russia). As part of the study, the problem of the circle of people in respect of whom employees are authorized to conduct the events in question was raised. In the course of the study, it was found that the range of persons in respect of whom it is necessary to conduct PRM needs to be significantly expanded. In addition, attention was drawn to the need for high-quality cooperation between employees of the penal enforcement inspections and the search department of the territorial body of the Federal Penitentiary Service of Russia during the PRM. The problematic issues of the detention of wanted persons and certain aspects of the consideration of submissions on extending the period of detention to 30 days were also considered.
