К вопросу о реализации поправки в статью 79 Конституции РФ

Статья посвящена правовому анализу, внесённой 2020 году поправки в статью 79 Конституции Российской Федерации, новая редакция которой предписывает не исполнять решения межгосударственных органов в том случае, если они приняты на основании интерпретации международных договоров Российской Федерации, противоречащей Конституции Российской Федерации. В статье рассмотрены практические проблемы применения данной поправки, а также, выделены проблемы изменённого положения статьи и пути их решения на современном этапе становления Российского законодательства.

On the issue of implementing the amendment to Article 79 of the Constitution of the Russian Federation
The article is devoted to the legal analysis of the amendment to Article 79 of the Constitution of the Russian Federation introduced in 2020, the new version of which prescribes not to execute decisions of interstate bodies if they are adopted on the basis of interpretation of international treaties of the Russian Federation that contradicts the Constitution of the Russian Federation. The article discusses the practical problems of applying this amendment, as well as highlights the problems of the amended provision of the article and ways to solve them at the present stage of the formation of Russian legislation.
